{"id":3991,"date":"2023-03-01T01:03:23","date_gmt":"2023-03-01T07:03:23","guid":{"rendered":"https:\/\/blog.remax.com.mx\/?p=3991"},"modified":"2023-08-10T16:11:01","modified_gmt":"2023-08-10T22:11:01","slug":"como-escriturar-mi-casa-o-departamento","status":"publish","type":"post","link":"https:\/\/bloginmobiliario.com.mx\/a\/como-escriturar-mi-casa-o-departamento\/","title":{"rendered":"\u00bfC\u00f3mo escriturar mi casa o departamento?"},"content":{"rendered":"<p>La escritura es el documento que comprueba que eres el propietario del inmueble, si todo est\u00e1 en regla te facilita la venta o si es una herencia permite transmitir el inmueble sin ning\u00fan problema.<br \/>\nAdem\u00e1s, tu escritura evita posibles fraudes, recuerda que el C\u00f3digo Civil establece como regla general que la transmisi\u00f3n de la propiedad debe hacerse mediante una escritura p\u00fablica ante notario.<\/p>\n<h4>Los documentos que debes de presentar ante el notario para escriturar son:<\/h4>\n<ul>\n<li>T\u00edtulo de propiedad<\/li>\n<li>Boletas de predial y agua de los \u00faltimos 5 a\u00f1os<\/li>\n<li>Identificaciones oficiales del vendedor y comprador; de estar casado, se debe acompa\u00f1ar tambi\u00e9n el acta de matrimonio<\/li>\n<li>En la adquisici\u00f3n de una departamento o casa en condominio se necesita la copia del r\u00e9gimen de propiedad en condominio, as\u00ed como una constancia de no adeudos emitida por el administrador del condominio.<\/li>\n<li>Si est\u00e1s haciendo tu tu tr\u00e1mite a trav\u00e9s de un cr\u00e9dito hipotecario, el banco es el que te asigna al notario<\/li>\n<\/ul>\n<h4>Pasos para escriturar:<\/h4>\n<ol>\n<li>Asistir a la cita con tu notario, quien solicitar\u00e1 un certificado y le avisar\u00e1 al Registro P\u00fablico de la Propiedad respecto a la compra.<\/li>\n<li>Obtener constancias de uso de suelo y de no gravamen<\/li>\n<li>Con dicha documentaci\u00f3n, el notario confirmar\u00e1 que quien te va a vender puede hacerlo y proceder\u00e1 a redactar la escritura.<\/li>\n<li>Ante \u00e9l se otorga el contrato de compraventa con las firmas del comprador y vendedor.<\/li>\n<li>El notario retiene y paga los impuestos tanto federales como locales que proceden por la compraventa.<\/li>\n<li>El notario expide un testimonio (copia certificada de la escritura con todos sus comprobantes) y tramita su inscripci\u00f3n en el<\/li>\n<li>Registro P\u00fablico de la Propiedad donde se registra al nuevo propietario.<\/li>\n<\/ol>\n<h4>\u00bfQu\u00e9 impuestos se pagan?<\/h4>\n<ul>\n<li>Federal: IVA e ISR<\/li>\n<li>Estatal: ISAI (Impuesto Sobre Adquisici\u00f3n de Inmueble)<\/li>\n<\/ul>\n<h4>\u00bfQu\u00e9 obligaciones tienen los notarios?<\/h4>\n<ul>\n<li>Entregar todos los impuestos retenidos del comprador y del vendedor 15 d\u00edas despu\u00e9s de la firma de la escritura.<\/li>\n<li>Entregar al vendedor el c\u00e1lculo del ISR con acuse de recibo.<\/li>\n<li>Entregar su factura electr\u00f3nica de honorarios y gastos notariales.<\/li>\n<li>Entregar la Factura-Complementaria electr\u00f3nica con la comprobaci\u00f3n de los impuestos retenidos.<\/li>\n<\/ul>\n<blockquote>\n<h2><em><strong>Recuerda que escriturar es la \u00fanica forma de garantizar la propiedad de tus bienes inmuebles<\/strong><\/em><\/h2>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>La escritura es el documento que comprueba que eres el propietario del inmueble, si todo est\u00e1 en regla te facilita la venta o si es una herencia permite transmitir el inmueble sin ning\u00fan problema.
